Most of the clients I meet with initially tell me Most of the clients I meet with initially tell me that they want to file a Chapter 7 bankruptcy or else they won't file.  Chapter 7 Bankruptcy, is a 4 month process where as a Chapter 13 can last from 36-60 months. Many clients have a friend who has filed a Chapter 7 and has started over quickly and the client wants to do the same. The problem is that not every person’s life and circumstances are the same. I have yet to meet a single client who has the identical situation that another client has. 

A Chapter 13 Bankruptcy is a government-sponsored debt consolidation plan. Contrary to popular belief, most chapter 13 debtors do not have to pay their debts in full. In fact, a super majority do not. You make payments back to a chapter 13 trustee based on your ability to pay.

There are a few reasons why you should consider filing a Chapter 13  vs. a Chapter 7.

REASON 1: INCOME
The truth is not every person can file a Chapter 7. The whole idea and policy behind bankruptcy are if you have the ability to make a payment to your creditors you should. 

REASON 2: ASSETS
A Chapter 13 Trustee does not exercise control over the debtor’s assets in a Chapter 13 like a Chapter 7 trustee does. A Chapter 7 trustee has the right to SELL your property that that isn't covered by your exemptions. 

REASON 3: MORTGAGE OR VEHICLE ARREARS
The call comes in.....the client is frantic.....”I have a foreclosure sale on my home on Tuesday and I can’t pay the mortgage company what do I do?”.

Or, the call comes in.........”they repossessed my car, and I need it for work, what do I do?”.

If a Chapter 7 is filed in either of these instances, relief is somewhat temporary. First, a foreclosure sale can be stopped by filing a Chapter 7 but the Chapter 7 does nothing to cure the arrears and solve the underlying problem. The Chapter 7  filing only provides a temporary solution. If a car is already repossessed, once the Chapter 7 is filed, the lender is barred from auctioning the vehicle off but we can’t force the creditor to return the vehicle. Chapter 13 will allow you to restructure both these debts AND get back repossessed property.

With so many Americans completely blindsided in every way by this crisis, it is easy to come to the end of your rope. The holidays can be tough for many even in the best of times so I can only imagine how hard it will be this year when so many are away from their families or isolated from friends. Whatever you do, hang on. Hope is right around the corner.

It is not the lack of a particular thing that brings us unhappiness. Rather, it is our attachment to the things we don’t have that causes much of our suffering. Most Americans are among the luckiest people to ever live on Earth. Most of us don’t have to wonder where our next meal will come from. We don’t live in the midst of war, where our primary goal each day is simply to stay alive. We don’t spend the winter shivering and trying to keep warm. While the COVID-19 pandemic has cast a shadow on our holiday season we still have so much to be grateful for. Don't forget everything you have.

I also think that for most of us, we have never been more out of our comfort zones than the past several months. We are all dealing with very serious issues regarding our health, finances, and equality but adversity allows us to grow and discover our resilience. Personally, I am refusing to give in to depair and fear. Instead I am going to focus on the new life and opportunities that being out of my comfort zone has presented me. I wish everyone a wonderful weekend and hope that each of you can find new opportunities outside of your comfort zone too!

Sadly, the financial shock that many of us felt ba Sadly, the financial shock that many of us felt back in March is still lingering and while our politicians make and break promises for more relief, hard working Americans are showing the strain from the uncertainty in the financial and employment markets.

What can you do to regain a sense of control?  Below are a few tips:

➡️ Start an emergency budget

Starting an emergency budget will show you the minimum amount of money you can live with and where your pain points are. An emergency budget is completely stripped of extras down to essential spending only. 

You can start by cutting:
-Subscription services
-Takeout 
-Entertainment
-Groceries

➡️ Contact your mortgage company or landlord

Your mortgage or rent check is possibly one of the biggest expenses you have, making it one of the hardest to keep up with during this crisis. Some states and banks are putting safeties in place but that’s not going to help everyone.

You can pick up the phone and call your lender or landlord and ask what your options are. 

➡️Learn about local relief programs

Some states and local governments have relief plans in place to help those in their community. 

You can contact the office of your local government to see what’s available to you, and follow your local government on social media to stay current on any new programs.

We all need to accept the fact that the next few months will still be full of uncertainty. Now is the time to ensure you are saving, planning, and sitting still momentarily to make sure you protect your financial and mental health.
